World Series 2008 - Terms & Conditions

1. The PokerStars *WSOP Main Event Qualifiers 2008 (hereinafter the "Qualifiers") organized by the operator of the Internet sites found at www.pokerstars.com  ("PokerStars") may qualify you for the World Series of Poker Main Event consisting of tournaments held during July 2-14, 2008 (the “July Tables”) and the final table (“Final Table”) to be held on November 9-10, 2008 (the July Tables and the Final Table together being referred to as the “Event”).
2. All satellites and tournaments forming part of the Qualifiers will be No Limit Hold'em.
3. Entrants must be 21 years of age to play in the Event. All entrants to the Event will be required to produce proof of age (passport or other valid picture ID). Entrants that are not able to present such proof will be excluded from participation in the Eventwith no compensation.
4. By participating in a Qualifier, or in the Event, you grant PokerStars the right to use your name and likeness for promotional purposes without further compensation and you expressly waive any claims against PokerStars in this regard.
5. Employees and relatives of employees of PokerStars and any entities affiliated or related to PokerStars are not eligible to enter a Qualifier. For these purposes, the term "relative" shall mean spouse, partner, parent, child or sibling.
6. The following benefits from PokerStars are available to all entrants to the Event:
   
   (a) who have earned their buy-in through a Cash qualifier and who:
   
   (i) agree to sign our Terms & Conditions;
   (ii) collect the 2008 *WSOP Player Bag from the PokerStars main representative office at the Palms Hotel, Las Vegas prior to the commencement of the Event; and
   (iii) wear the PokerStars branded hat and t-shirt/fleece from the 2008 *WSOP Player Bag provided by PokerStars (or such other branded clothing as PokerStars shall provide) (the “PS Clothing”) exclusively throughout the entire duration of the Event
   
   (b) who have earned their buy-in through a NonCash Qualifier ( FPP, TLB, VIP) or that have bought their seat with FPPs or W$s such entrants being required pursuant to the terms of such Non Cash Qualifiers, to:
   
   (i) sign and abide by these Terms & Conditions
   (ii) collect the 2008 *WSOP Player Bag from the PokerStars main representative office at the Palms Hotel, Las Vegas prior to the commencement of the Event
   (iii) wear the PokerStars branded hat and t-shirt/fleece from the 2008 *WSOP Player Bag provided by PokerStars (or such other branded clothing as PokerStars shall provide) (the “PS Clothing”) exclusively throughout the entire duration of the Event
   (each of the entrants in paragraphs 6(a) and (b) together herein referred to as entrants who have taken the “Sponsored Option”);
   
   Benefits:
   
   Either:
• (i) the cost of 8 nights accommodation at the Palms Hotel, Las Vegas from July 2nd 2008 at PokerStars' expense
  
  Or (at the entrant's option)
  
  (ii) US$1,000 in cash  which will be deposited in the player's PokerStars' account within 5 business days  of the player collecting his/her 2008 *WSOP Player Bag
• PokerStars will cover the cost of the accommodation of any player that chooses option (i) above (i.e. to receive accommodation at the Palms Hotel, Las Vegas) and:
  • is still in the July Tables on July 10th 2008, until  14th July 2008; and
  • reaches the Final Table – from 8th – 10th November, 2008
• A free shuttle bus service every morning from 2008, July 3rd to July 13th from the Palms Hotel to the Rio Hotel & Casino, Las Vegas.
• 2008 *WSOP PokerStars Player Bag containing approved clothing to be worn at the Event
• Cash bonus incentive for appearances at the main feature table at the Event, filmed by ESPN (“Event TV Table”) as follows:

For the purposes of this term 6, the PokerStars branded hat and t-shirt/fleece worn by an entrant must be from the 2008 *WSOP Player Bag provided by PokerStars to the entrant for this purpose.  

The cash payment will be made directly to the player’s PokerStars account. Payment to player’s PokerStars account will be made within 2 weeks of the Event. If we are not able to verify a player’s Event TV Table appearance, we will credit the player’s PokerStars account within 2 weeks of the Event being aired on TV.

Final Table Bonus Incentive – An entrant to the Event, that chose the Sponsored option and that reaches the Event’s Final table will be entitled to the following bonuses subject to the player entering into an endorsement agreement with PokerStars on PokerStars' standard terms and conditions including an obligation on the player to assist PokerStars and act as a PokerStars spokesman during the Event and for one calendar year thereafter, including, but not limited to, meeting with press and participating in other events conducted by PokerStars:


• 1st place: US$1,000,000
• 2nd place: US$400,000
• 3rd place: US$300,000
• 4th-5th place: US$200,000
• 6th-9th place: US$100,000
These values form the basis of a yearly contract with PokerStars and will be paid as part cash, part tournament entries (to include expenses and buy-in).

For the avoidance of doubt it is hereby clarified that the final table bonuses as detailed above shall be your complete compensation for entering into the aforementioned endorsement contract unless PokerStars elects, at its sole discretion, to compensate you further in any way.
7. All entrants who have taken the Sponsored Option and reach the Final Table agree as follows:
   
   (a) to wear the PS Clothing that will be provided to you by PokerStars specifically for the Final Table which will be branded as follows:
   - front of the cap with the spade on the back
   - high mid-chest of the t-shirt
   - right chest of fleece with 2 spades at the top of the sleeves
   
   Or in such other manner as PokerStars may, in it’s absolute discretion, determine.
   
   (b) that you will not wear any other logo bearing the name, trademark or indicial other than PokerStars without the prior, written permission of PokerStars which shall be sought at least 15 working days in advance of the commencement of the Final Table;
   
   (c) that the guidelines contained in this term 7 will remain applicable to entrants to the Event regardless of any changes made by the organizer of the Event to the logo policies for the Event
8. Any cash payment bonuses that may be made under these terms and conditions are paid in recognition of the player wearing the PokerStars Branded Clothes throughout the Event.  Accordingly, PokerStars may pay no bonus or a bonus reduced by an amount determined by them in their absolute discretion if (a) at any public appearances in the Event (including live play at all tables, all television appearances, photo shoots, press conferences or any equivalent opportunities) the player does not wear or for whatever reason is prevented from wearing the Pokerstars Branded Clothes; or (b) wears the name, trade mark, logo or indicia of any business that is in direct or indirect competition with PokerStars.  If an entrant to the Event wishes to wear the logo, trade mark, name or indicia of a business that does not compete directly or indirectly with PokerStars, the entrant must obtain PokerStars' prior written permission to do so. Failure to obtain such permission will allow PokerStars to withhold a bonus payment in its entirety or to reduce such bonus by an amount determined by it in its absolute discretion. During the Event, strict rules regarding player behavior will be enforced by the organizers of the Event. These may include penalties, including, without limitation, disqualification, for foul language, abuse of dealers, players or any other person during the Event, or any other behavior that the organizer of the Event, in its sole judgment, believes to be detrimental to its conduct of the Event. If you are penalized or disqualified from the Event as a result of any infraction of the rules of the Event, PokerStars assumes no responsibility for your entry into the Event, forfeited.
9. During the Event, strict rules regarding player behavior will be enforced by the organizers of the Event. These may include penalties, including, without limitation, disqualification, for foul language, abuse of dealers, players or any other person during the Event, or any other behavior that the organizer of the Event, in its sole judgment, believes to be detrimental to its conduct of the Event. If you are penalized or disqualified from the Event as a result of any infraction of the rules of the Event, PokerStars assumes no responsibility for your entry into the Event, which may be forfeited.
10. The first time that a player wins a Qualifier, the prize which that player wins is the entry fee to the Event (US$10,000) plus US$2,500 spending money for the Event. The prize will be deposited into the player’s PokerStars account.  If a player wins additional Qualifiers, that player's PokerStars account will be credited with W$10,000 and that player will receive US$2,500 in cash.
11. By entering a Qualifier each entrant unreservedly agrees to these terms and conditions which govern the Qualifier and the awarding of the prizes.
12. By entering into a Qualifier each entrant agrees to release, discharge and hold harmless PokerStars, their legal representatives, their affiliates, subsidiaries, agencies and their respective officers, directors, employees and agents, from any damages whatsoever, including any personal injury suffered or sustained in connection with the acceptance of any of the prizes.
13. In case of any disputes regarding any participation rights, all matters relating to the awarding of prizes and/or these terms or conditions, the final decision lies with PokerStars management, is binding and shall not be subject to review or appeal by an entrant or by any third party.
14. PokerStars reserves the right, at any time, to alter these terms and conditions at its sole discretion including to cancel, modify or suspend a Qualifier if, in its sole judgment PokerStars believes that the Qualifier is not capable of being conducted as specified.
15. All players participating in a Qualifier must abide by all PokerStars terms of service requirements as listed at http://www.pokerstars.com/poker/room/tos/, and by PokerStars general tournament terms and conditions listed at http://www.pokerstars.com/poker/tournaments/rules/.
16. All participating qualifying players in the Qualifiers and the Event will be required to accept these Terms and Conditions when they register for the Event through our registering website, Regonline, prior to  playing in any World Series event.
17. For the avoidance of doubt the Terms & Conditions shall apply to players and entrants in all Qualifiers and throughout the entirety of the Event with the sole exception of members of “Team PokerStars Pro” or employees of PokerStars. Without prejudice to any other rights or remedies available to it at law, if an entrant to a Qualifiers and/or the Event breaches in whole or in part any provision contained in these Terms and Conditions, PokerStars reserves the right to take such action as it sees fit, including terminating such entrant’s account with PokerStars and/or excluding the entrant from future events sponsored by PokerStars.
18. These Terms and Conditions and matters relating hereto shall be governed by, and construed in accordance with the laws of the Isle of Man and shall be subject to the exclusive jurisdiction of the Isle of Man courts.
