Terms and Conditions
The following are the terms and conditions of the “PokerStars Ocean's Thirteen Darfur Charity Tournaments” (the “Charity Tournaments”) which consist of three charity tournaments organized by the operator of the Internet sites found at www.pokerstars.com and www.pokerstars.net (the "PokerStars"). Your participation in a Charity Tournament shall be deemed to be your complete acceptance of the terms and conditions herein.
- Employees and relatives of employees of PokerStars and any entities affiliated or related to the PokerStars are not eligible to enter. For these purposes, the term "relative" shall mean spouse, partner, parent, child or sibling.
- Entrants must be 18 years of age or of legal age of majority in their jurisdiction (whichever the greater) to participate in a Charity Tournament. You may be asked at any stage to provide to PokerStars or a third party proof of age and/or identity. All players must be able to present a valid passport to verify their age and/or identity. Players that are not able to present such proof will be excluded from participation in a Charity Tournament with no compensation.
- Each entrant shall only be entitled to make one entrance to a Charity Tournament. In the event that PokerStars deems that an entrant has made multiple applications to enter a Charity Tournament or has executed any act in bad faith in relation to a Charity Tournament, such entrant shall be excluded from such Charity Tournament and therefore ineligible from winning any of the Prizes, as defined below.
- All Charity Tournaments will be in the form of No Limit Hold'em tournaments.
- Entrants to a Charity Tournament shall be eligible to win one of the following prizes (collectively the "Prizes"):
- a pair of tickets to the official world premiere main screening event of Ocean's 13 at the Cannes Film Festival on 24th May, 2007 (the "World Premiere").
- a pair of tickets to the official premiere screening main event of Ocean's 13 to be held at Grauman's Chinese Theatre in Los Angeles on 5th June, 2007 (the "Official Premiere").
- the original autographs of each of the main cast members of Ocean's 13 on a poker table top.
- a DVD of the film Ocean's Thirteen signed by the cast.
- Each entrant shall only be entitled to make one entrance to each Charity Tournament. In the event that PokerStars deems that an entrant has made multiple applications to enter a Charity Tournament or has executed any act in bad faith in relation to a Charity Tournament, such entrant shall be excluded from such Charity Tournament and therefore ineligible from winning any of the Prizes, as defined below.
- By participating in a Charity Tournament, or at either of the World Premiere or the Official Premiere, you are deemed to have granted PokerStars the right to use your name, likeness and image for promotional purposes without the requirement for any payment to you and you expressly waive any claims against PokerStars in this regard.
- Prizes are neither transferable nor exchangeable and cannot be exchanged for money or money's worth.
- In the event that for any reason whatsoever any winning entrant does not take an element of a Prize at a time stipulated by PokerStars, then such winning entrant shall be deemed to have forfeited his/her claim to such Prize and PokerStarsshall not have any obligation to compensate the winning entrant in any way.
- By entering a Charity Tournament each entrant unreservedly agrees to these terms and conditions which govern the Charity Tournament and the awarding of the Prizes.
- By entering a Charity Tournament each entrant agrees to release, discharge and hold harmless PokerStars, their legal representatives, their affiliates, subsidiaries, agencies and their respective officers, directors, employees and agents, from any damages whatsoever, including any personal injury suffered or sustained in connection with the acceptance of any of the Prizes.
- PokerStars reserves the right, at any time, to alter these terms and conditions at its sole discretion including to cancel, modify or suspend a Charity Tournament if, in its sole judgment PokerStars believes that the Charity Tournament is not capable of being conducted as specified.
- During a Charity Tournament, strict rules regarding player behavior will be enforced. These may include penalties, up to and including disqualification, for foul language, abuse of dealers, players or any other person during a Charity Tournament, or any other behavior that PokerStars, in its sole judgment, believes to be detrimental to its conduct of the Charity Tournament.
- When playing in a Charity Tournament you confirm that the name and address which are registered in your PokerStars account are correct and up to date. The person whose name appears on any PokerStars account which wins a Charity Tournament will be deemed to be the person who played and won the Charity Tournament, and that person must attend the World Premiere or the Official Premiere, as the case may be, if applicable to the Prize won.
- Any attempt by a player to alter or duplicate their PokerStars account to become eligible for a Charity Tournament will result in forfeiture of any Prize won and may result in the closure of such player's PokerStars account.
- In the case of disputes in regards to the participation rights, all matters relating to the awarding of the Prizes and or the terms and conditions, the final decision lies with PokerStar's management, is binding and shall not be subject to review or appeal by an entrant or any third party.
- PokerStars reserves the right to award a monetary prize in equal or greater value as a Prize in place of a Prize, at its sole discretion. The value of a Prize shall be determined in the basis of its actual value and not any potential value or prize receivable as a consequence of the Prize.
- All players participating in a Charity Tournament must abide by all PokerStars terms of service requirements as listed at http://www.pokerstars.com/poker/room/tos/, and by PokerStars general tournament terms and conditions listed at http://www.pokerstars.com/poker/tournaments/rules/.
- These terms and conditions and matters relating hereto shall be governed by, and construed in accordance with Isle of Man law and shall be subject to the exclusive jurisdiction of the Isle of Man courts.
